Divorce

A “divorce” is the termination or dissolution of a marriage, not to be confused with an annulment, which is a declaration that a marriage is void for some reason (incompetence, intoxication, fraud, force, or illegality).

The divorce process begins once either party files a “Divorce Complaint” alleging that the marriage is irretrievably broken. Either you or your spouse must be a Pennsylvania resident for at least six months before you are eligible to file for divorce in PA.

In Pennsylvania, pursuant to 23 Pa.C.S.A. §3301, there are essentially four grounds (see a-d below) upon which a plaintiff may rely when filing a divorce complaint.
