In Pennsylvania, child pornography charges are located in the section of laws prohibiting “Sexual Abuse of Children.” It is a crime under said laws to intentionally view or knowingly possess any depiction of a child under the age of 18 years engaging in a prohibited sexual act or simulation of such act. Additionally, it is a crime to possess any depiction for purposes of disseminating the depiction to others. A first offense for either crime is a felony of the third degree (F3) and any subsequent offense is a felony of the second degree (F2).
